The new Law No. 51/2019/QH14 which will take effect on July 1, 2020 is in concern by various foreigners who are currently in Vietnam or will visit Vietnam in the future. <h3 dir="ltr">Change about the tourist visa validity</h3>

According to this new Law No. 51/2019/QH14, visitors who enter Vietnam will be issued a temporary residence stamp upon arrival with the duration of stay matching their visas. However, with the tourist visa having for more than 30 days of validity, tourists are only given a 30-day temporary residence stamp and they may consider extending visa every 30 days if they do not want to leave Vietnam.
<h3 dir="ltr">Change of visa status without leaving the country for eligible foreigners</h3>
The new law also gives provisions on cases of conversion of visa purposes. Currently, if a visa holder wants to change his/her visa to another type/category, he/she needs to leave Vietnam and enter again under the new visa but now they can change visa purpose without exiting Vietnam, specifically:

Having proof of being an investor or a representative of a foreign organization investing in Vietnam in accordance with the law of Vietnam.

Have documents proof of being a parent, spouse or child with an inviting or guarantee individual.
</li>
<li dir="ltr">
Being invited or guaranteed to enter Vietnam by agencies or organizations and having work permits or certifications of work permit exemption.
</li>
<li dir="ltr">
Entering with an e-visa and obtaining a work permit or certification of work permit exemption as prescribed by the labor law.
</li>
<li dir="ltr">
Thanks to this change, more foreigners now can be able to change their visa status without leaving Vietnam, making it easier to transition to long-term visa status.

<h3 dir="ltr">Change in Vietnam visa exemption</h3>

Provisions on visa exemption for 30 days’ temporary residence for foreigners who enter coastal economic zones under the Government’s decision when meeting all conditions:

having an international airport,
</li>
<li dir="ltr">
having their own space;
</li>
<li dir="ltr">
having defined geographical boundaries and be separate from the mainland;
</li>
<li dir="ltr">
being in line with socio-economic development policies while posing no threat to national defense, security, social order and safety of Vietnam.
</li>
</ul>
Moreover, the new law also abolish the rule that “foreigners entering Vietnam unilaterally on a visa-free basis must be at least 30 days from the time of their previous exit from Vietnam” to create conditions for foreigners to enter Vietnam on a unilateral visa exemption, then go to a third country and return to Vietnam to continue traveling. That means citizens from Belarus, Denmark, Finland, France, Germany, Italy, Japan, Korea, Norway, Russia, Spain, Sweden, and the United Kingdom who enter Vietnam with unilateral visa exemption can enter this country at any time with 15-day visa exemption from July 1, 2020.
<h2 dir="ltr">Change on Vietnam temporary card which take effect on July 1, 2020</h2>

Due to more codes of Vietnam visa as mentioned above, there will be more codes for Vietnam temporary card. Now the eligible applicants can apply for Vietnam temporary residence card of either of the following codes which matches to their visa code, including NG3, LV1, LV2, LS, ĐT1, ĐT2, ĐT3, NN1, NN2, DH, PV1, LĐ1, LĐ2, TT.
Law No. 47 only stipulates a type of visa, temporary residence cards with the ĐT symbol for a period of 5 years. According to this new law, based on the amount of investment capital, sectors, trades, geographical areas, incentives, investment incentives for granting visas that temporary residence cards will be granted a time limit and appropriate symbols. There are also some changes in the validity of those temporary residence cards specifically as follows:

TRC with ĐT1 code: valid for up to 10 years,

TRC with NG3, LV1, LV2, LS, ĐT2 and DH: valid for up to 05 years,

TRC with LĐ1, LĐ2, and PV1: valid for up to 02 years.

However, same as the current Law No. 47/2014/QH13, the temporary residence card validity will be 30 days shorter than the remaining validity of the applicant’s passport.

There are some conditions that foreigners must meet to be granted work permit when they work in Vietnam under the new regulations:

According to Article 7<a href="http://news.chinhphu.vn/Home/Decree-guiding-some-articles-of-Labor-Code-on-foreign-workers-in-Viet-Nam/20162/26715.vgp" target="_blank" rel="noopener noreferrer nofollow"> Decree No.11/2016/ND-CP</a> and Clauses 1, 2, 3, 4, 5, 6, 7 and 8 of Article 172<a href="http://vbpl.vn/TW/Pages/vbpqen-toanvan.aspx?ItemID=11013" target="_blank" rel="noopener noreferrer nofollow"> Labor Code No.10/2012/QH13</a>, the foreigners may be eligible to get work permit exemption in Vietnam if they are included in 1 of those scenarios listed below:
1.&nbsp; Capital-contributing members or owners of limited liability companies.
2. Members of the Board of Directors of joint-stock companies.
3. Chiefs of representative offices and directors of projects of international organizations or non-governmental organizations in Vietnam.
4. Those who stay in Vietnam for under 3 months to offer services for sale.
5. Those who stay in Vietnam for under 3 months to deal with complicated technical or technological problems that adversely impact or are at risk of exerting adverse impacts on production and business activities and these problems cannot be handled by Vietnamese and foreign experts who are currently in Vietnam.
6. Foreign lawyers possessing a professional practice license in Vietnam in accordance with the Law on Lawyers.
7. It is in accordance with a treaty to which Vietnam is a contracting party.
8. Those who are studying and working in Vietnam, provided that the employer shall notify their employment to the provincial-level state management agency of labor 7 days in advance.
9. Other cases as stipulated by the Government
10. Foreign workers who are internally transferred within an enterprise operating in the 11 service sectors in the list of Viet Nam’s commitments on services to the World Trade Organization, including: business, communication, construction, distribution, education, environment, finance, healthcare, tourism, cultural entertainment and transport;
11. Foreign workers entering Viet Nam to provide advisory services and technical expertise or perform other tasks serving research, construction, appraisal, monitoring and evaluation, management and implementation of programs/projects funded with official development assistance (ODA) as specified and agreed in international agreements on ODA between competent authorities of Viet Nam and other countries;
12. Foreign workers who are issued with a license for the practice of journalism in Viet Nam by the Ministry of Foreign Affairs in accordance with the law;
13. Foreign workers who are teachers of foreign organizations that are sent to Viet Nam by such organizations to teach and research in international schools under the management of foreign diplomatic missions or international organizations in Viet Nam or permitted by the Ministry of Education and Training to teach and research in Viet Nam’s education and training institutions;
14. Volunteers certified by foreign diplomatic missions or international organizations in Viet Nam;
15. Foreign workers coming to Viet Nam to work as experts, managers, executive directors or technical employees with a period of less than 30 days and no more than 90 cumulative days in 01 years;
16. Foreign workers entering Viet Nam to implement international agreements to which central and local state agencies are signatories as prescribed by the law;
17. Students studying in foreign schools and institutions having agreements on internship in agencies, organizations and enterprises in Viet Nam;
18. Family members of diplomatic agents of foreign diplomatic missions in Viet Nam permitted for working by the Ministry of Foreign Affairs, except where international treaties to which the Socialist Republic of Viet Nam is a signatory that contains provisions different from this;
19. Foreign workers who have official passports to work for state agencies, social organizations and socio-political organizations;
20. Other cases decided by the Prime Minister at the proposal of the Ministry of Labor – Invalids and Social Affairs.

Departments of Labor – Invalids and Social Affairs shall be authorized to certify foreign workers exempt from work permits, according to Clause 1 of Article 8 Decree No.11/2016/ND-CP.
<h2 dir="ltr" >How can foreigners get Vietnam work permit exemption certificate in Vietnam?</h2>
Pursuant to Clause 2 of Article 8 Decree No.11/2016/ND-CP, “the employer can request the Department of Labor – Invalids and Social Affairs, where the foreign worker is expected to work, to certify that the foreign worker is exempt from work permit at least 07 working days before the date the employee starts working, except for cases provided in Clause 4 and Clause 5 of Article 172 of the Labor Code and Point e, Clause 2 of Article 7 of this Decree”.
Below are 4 steps of the process to get a Vietnam work permit exemption certificate that foreign employers need to follow:
Step 1: Before applying for Vietnam work permit exemption certification, the employers need to prepare needed documents listed below:

A request for confirming the foreign employee is eligible for work permit exemption (Form 10 issued together with the<a href="http://vbpl.vn/bolaodong/Pages/vbpq-van-ban-goc.aspx?ItemID=35326" target="_blank" rel="noopener noreferrer nofollow"> Circular No. 03/2014/TT-BLĐTBXH</a>);
</li>
<li dir="ltr">
Profile of the foreign worker comprising full name, age, gender, nationality, passport number, start date and end date of employment, job placement of the foreign worker;
</li>
<li dir="ltr">
Proof of eligibility for work permit exemption
</li>
<li dir="ltr">
Proof of eligibility for work permit exemption include 01 photocopy to be collated with the original or 01 certified copy. Foreign documents are exempt from consularization, but must be translated into Vietnamese and certified in accordance with regulations of Viet Nam.
</li>
</ul>
Step 2: After completing the documents mentioned above, the foreign employers shall submit the documents to the Department of Labor, War Invalids and Social Affairs in the province where the foreigner is expected to work.
Step 3. After submitting documents, the Department of Labor, War Invalids and Social Affairs shall check the documents and receive them in case they are full and valid, or request to add otherwise.
Step 4: Within 03 working days from the date of receipt of a full application for Vietnam work permit exemption, the Department of Labor – Invalids and Social Affairs will confirm a work permit exemption and send a written confirmation of work permit exemption to the employer. In case work permit exemption is not granted and the employee is ineligible, a document clearly stating the reasons must be issued in Form No. 11 issued together with the Circular No. 03/2014/TT-BLĐTBXH).

a/ Performing labor contracts;
b/ Being intra-corporate transferees;
c/ Implementing contracts or agreements on business, commerce, finance, banking, insurance, science and technology, culture, sports, education, vocational education, or health;
d/ Providing contractual services;
dd/ Offering services;
e/ Working for foreign non-governmental organizations or international organizations in Vietnam that are licensed to operate in accordance with Vietnamese law;
g/ Working as volunteers;
h/ Taking charge of establishing commercial presence;
i/ Working as managers, executives, specialists or technical workers;
k/ Participating in the performance of bidding packages and projects in Vietnam.

a/ Enterprises operating in accordance with the Law on Enterprises, the Law on Investment, or treaties to which the Socialist Republic of Vietnam is a contracting party;

c/ Representative offices and branches of enterprises, agencies or organizations established under licenses of competent agencies;

Pursuant to Clause 15 Article 1 of the Government’s Decree No. 88/2015/ND-CP dated October 7, 2015, amending and supplementing a number of articles of the Government’s Decree No. 95/2013/ND-CP on penalties for administrative violations against regulations on employment, social insurance, social insurance, and Vietnamese guest workers:
<h3 dir="ltr">1. A foreign worker in Vietnam who commits any of the following violations shall be expelled:</h3>
<ul>
<li dir="ltr">
Working without a work permit as prescribed by law, except for those exempt from work permits;
</li>
<li dir="ltr">
Using an expired work permit.
</li>
</ul>
<h3 dir="ltr">2. An employer that fails to submit a report on employment of foreigners to the labor authority, or submits an insufficient report, or submits report behind schedule shall be subject to a fine of VND 1,000,000 – VND 2,000,000.</h3>
<h3 dir="ltr">3 An employer who employs foreign workers in Vietnam without work permits or Vietnam work permit exemption certificates, or employs foreign workers using expired work permits shall be subject to a fine of:</h3>
<ul>
<li dir="ltr">
VND 30,000,000 – VND 45,000,000 if the violation involves 01 – 10 workers;
</li>
<li dir="ltr">
VND 45,000,000 – VND 60,000,000 if the violation involves 11 – 20 workers;
</li>
<li dir="ltr">
VND 60,000,000 – VND 75,000,000 if the violation involves more than 20 workers.
</li>
</ul>
4. Additional penalty: The employer who commits the violation mentioned shall have its operation suspended for 1 – 3 months.
So, as a foreign worker, do you want to work in Vietnam illegally without a valid work permit/work permit exemption certificate? As an employer, do you want to employ foreigners who have no valid work permits/work permit exemption certificates but cheap cost and more dangers?

Work Permit in Vietnam-Regulations and Penalties for administrative violations

This article may supply you with information about this case.<div class="blog-content"><h2 dir="ltr">What is Vietnam Work Permit?</h2>A work permit or work visa is the permission for foreigners to take a job within a foreign country. Vietnamese government issued work permit and multiple entry business visa for foreigners who wish to work and stay in Vietnam for three months or more.So who are eligible to apply for Vietnam Work Permit? Pursuant to the Decree No. 11/2016/ND-CP on February 03, 2016, Chapter 1, Article 2, almost all foreigners working in Vietnam must hold this type of document, but there also some exemption. Clauses 1 thru 9, Article 172 of the Labor Code No. 10/2012/QH13 ruled:<ol><li>Capital-contributing members or owners of limited liability companies.</li><li>Members of the Board of Directors of joint-stock companies.</li><li>Chiefs of representative offices and directors of projects of international organizations or non-governmental organizations in Vietnam.</li><li>Those who stay in Vietnam for under 3 months to offer services for sale.</li><li>Those who stay in Vietnam for under 3 months to deal with complicated technical or technological problems that adversely impact or are at risk of exerting adverse impacts on production and business activities and these problems cannot be handled by Vietnamese and foreign experts who are currently in Vietnam.</li><li>Foreign lawyers possessing a professional practice license in Vietnam in accordance with the Law on Lawyers.</li><li>It is in accordance with a treaty to which Vietnam is a contracting party.</li><li>Those who are studying and working in Vietnam, provided that the employer shall notify their employment to the provincial-level state management agency of labor 7 days in advance.</li><li>Other cases as stipulated by the Government.</li></ol><h2 dir="ltr">When can foreigners re-grant Vietnam Work Permit?</h2></div></div><img src="https://evisaonlinevietnam.org/strapi/upload/5/6/Vietnam_Work_Permit_1_570ab275bc.jpg" alt="Vietnam Work Permit 1.jpg" srcset="https://evisaonlinevietnam.org/strapi/upload/thumbnail_Vietnam_Work_Permit_1_570ab275bc.jpg 208w,https://evisaonlinevietnam.org/strapi/upload/small_Vietnam_Work_Permit_1_570ab275bc.jpg 500w,https://evisaonlinevietnam.org/strapi/upload/medium_Vietnam_Work_Permit_1_570ab275bc.jpg 750w," sizes="100vw" width="800" height="600"><div class="cont"><div class="blog-content">On Article 13, section 4 of the Labor Code No. 10/2012/QH13, there are 2 cases that a work permit can be re-granted:<ol><li>The valid work permit is lost or damaged, or has its contents changed, except the special cases.</li><li>The work permit remains valid for at least 5 days and at most 45 days.</li></ol><h2 dir="ltr">What documents should you prepare to re-grant Vietnam Work Permit?</h2>Foreigners who are under cases to re-grant Vietnam work permit need to prepare:<ol><li>A written request for re-grant of a work permit, made by the employer according to regulations of the Ministry of Labor, War Invalids and Social Affairs.</li><li>Two color photos (4 cm x 6 cm, white background, front facing, bareheaded, no glasses) taken within 6 months prior to the date of dossier submission.</li><li>The granted work permit<ol><li>If the work permit is lost, certification of a Vietnamese commune-level public security agency or of a competent foreign authority is required in accordance with law;</li><li>If the work permit has its contents changed, papers proving such change are required;</li><li>If the work permit remains valid for just between 5 days and 45 days, a health certificate issued by a competent foreign or Vietnamese health establishment within 12 months prior to the date of dossier submission and one of the papers specified in Clause 7, Article 10 of Decree No. 11/2016/ND-CP on February 03, 2016 are required;</li><li>If the foreign worker’s work permit was granted under the Government’s Decree No. 102/2013/ND-CP of September 5, 2013, detailing a number of articles of the Labor Code regarding foreign workers in Vietnam, a paper proving his/her satisfaction of the requirements specified in Clause 3, 4 or 5, Article 3 of Decree No. 11/2016/ND-CP on February 03, 2016 is required.</li></ol></li><li>All papers may be either copies enclosed with their originals for comparison or certified copies. If being made in a foreign language, they shall be exempted from consular legalization but be translated into Vietnamese and certified in accordance with Vietnamese law.</li></ol><figure class="image"><img style="aspect-ratio:800/600;" src="https://evisaonlinevietnam.org/strapi/upload/5/6/Vietnam_Work_Permit_2_1aa81d3909.jpg" alt="Vietnam Work Permit 2.jpg" srcset="https://evisaonlinevietnam.org/strapi/upload/thumbnail_Vietnam_Work_Permit_2_1aa81d3909.jpg 208w,https://evisaonlinevietnam.org/strapi/upload/small_Vietnam_Work_Permit_2_1aa81d3909.jpg 500w,https://evisaonlinevietnam.org/strapi/upload/medium_Vietnam_Work_Permit_2_1aa81d3909.jpg 750w," sizes="100vw" width="800" height="600"></figure><h2 dir="ltr">What is the process of re-granting Vietnam work permit?</h2></div></div><div class="cont"><div class="blog-content">Pursuant to Article 15 of the Decree No. 11/2016/ND-CP on February 03, 2016:<ol><li dir="ltr">In case your current work permit remains valid for at least 5 days and at most 45 days, at least 5 days and at most 45 days before it expires, the employer shall submit a dossier of request for re-grant of a work permit to the provincial-level Department of Labor, War Invalids and Social Affairs that has granted such work permit.</li><li dir="ltr">Within 3 working days after receiving a complete dossier of request for re-grant of a work permit, the provincial-level Department of Labor, War Invalids and Social Affairs shall re-grant a work permit. In case of refusal, it shall issue a written reply clearly stating the reason.</li><li dir="ltr">After the foreign worker mentioned at Point a, Clause 1, Article 2 of the Decree No. 11/2016/ND-CP (Performing labor contracts) is re-granted a work permit, he/she and his/her employer shall sign a written labor contract in accordance with Vietnamese labor law before the date the foreign worker is expected to continue working.</li></ol>Within 5 working days after the labor contract is signed, the employer shall send a copy of this contract to the provincial-level Department of Labor, War Invalids and Social Affairs that has re-granted the work permit.<h2 dir="ltr">Changes in Vietnam’s regulation on work permit 2020</h2></div></div><div class="cont"><div class="blog-content">The National Assembly of Vietnam has passed the New Labor Code and it will take effect from 1 January 2021. This New Labor Code is expected to give the labor authorities more power to control and review the status of foreign workers employed by/at Vietnamese employers. Therefore, the immediate sponsor for visa/temporary resident cards for the foreign national could be changed from the Vietnam organization to the Vietnamese husband/wife of the foreign national. Regulations to be issued in due course should give guidance on this matter.Foreign national owners or shareholding members of limited liability companies and shareholders being members of the board of directors of joint stock companies with a certain threshold of capital contributions are entitled to a work permit exemption.
